CRIMINAL TRESPASS POLICY OF THE HOUSING AUTHORITY OF ELGIN
The Housing Authority of Elgin, after this called the
"Authority", is aware of the problem the Authority and the authority's
tenants face with the unwanted presence of persons on in or about the lands of
the Housing Authority of Elgin. Recognizing the seriousness of illegal drug
activity, as well as other criminal activity, and the interference by some
individuals of another person's lawful use or enjoyment of Authority property
that each tenant acknowledges is being supported in whole or in part with State
funds or Federal funds. Recognizing the seriousness of illegal drug activity, as
well as other criminal activity, the Authority adopt the following policy to
enhance the safety, health , well-being, lawful use and enjoyment of Authority
residents and Authority property. The goal of the following policy is to reduce criminal
activity involving drugs and other activity that threaten the peace and tranquility,
lawful use and enjoyment needed for public housing and its residents. The following
policy is to be carried out and enforced under the laws of the City of
Elgin and the Sate of Illinois:
A. The Authority shall notify either orally or in writing , any
nonresident who either has no legal right to be on the property of the Authority,
or is not an invited guest of a resident. The warning shall say that such person
is forbidden from entry on the property of the Authority and if such person
enters upon the property, after receiving before such entry, notice from
the Authority or its representative that such entry is forbidden, the Authority
many prosecute for criminal trespass under the law. Warning will be issued to
non-resident to include invited guests who:

Engage or is suspected of engaging in drug related
activity on the property of the Authority.

Engage in criminal activity in which a deadly or dangerous
weapon was used or threatened to be used, or any activity that resulted in
physical injury to another person, while on the property of the Authority.

Engage in criminal activity that is nonviolent and causes no
physical injury to another person.

Engage in verbal or physical confrontation with law
enforcement personnel, residents, guests, or Authority personnel while on
the property of the Authority.

Are living in Public Housing in violation of tenant
agreement.

Remains in a Public Housing unit against the wishes of the
lawful tenant.

Causes damage to Authority property by malicious act.

Behaves in a way that interferes with another person's
lawful use or enjoyment of Authority property.
